Swimming pools in KwaZulu-Natal

Durban's own by-laws reach into pool projects in ways most owners don't expect: where the shell may sit next to a servitude, and where the water to fill it may come from.

On the KZN coast the practical complications of a pool project are mostly municipal. eThekwini has a building rule aimed specifically at pools near servitudes, a water by-law clause that names pool filling, and a bulk water system that was rationed more than once in 2026.

Inland towns such as Pietermaritzburg, Newcastle and Ladysmith fall under their own municipalities, so check local rules there; the points below are about eThekwini.

Keep the shell clear of servitudes

Durban's Building By-laws, still published by eThekwini, have a section on "swimming baths": any pool, plunge pool or paddling pool holding more than 2,500 litres and over 450 mm deep. If the pool relies on the surrounding soil for sideways support, as an in-ground shell does, no point of it may be closer to a servitude boundary than one and a half times the pool's depth at that point. A pool 1.6 m deep at one end would need that end at least 2.4 m from the servitude line.

The City Engineer can allow a smaller gap if other measures make the pool stable. On a small stand with a sewer or stormwater servitude across the garden, this rule can decide where a pool fits at all.

  • Ask the builder to plot every servitude from your title deed and approved site plan before designing.
  • If the pool has to sit closer, ask who will engineer and motivate the alternative.

Filling from a borehole needs consent

eThekwini's Water By-law, 2023 says you may not use water from a source other than the municipal supply to fill a swimming pool without the municipality's prior consent. To get it, you must show that the water meets the SANS 241-1 drinking-water standard and isn't a health risk, and the consent can be withdrawn if the water stops complying.

That matters because a borehole or rainwater tank is the obvious answer when municipal supply is unreliable. Get the water tested and the consent in place before you plan to fill from it.

Time the fill around the supply

eThekwini's bulk water was rationed in March 2026, with reservoirs on the Southern Aqueduct and around Pinetown on limited pumping hours. In early October a pump failure at uMngeni-uThukela Water cut supply to eThekwini by about 50 megalitres a day, affecting areas fed by the Northern Aqueduct and Mount Moriah Reservoir, and later that month restrictions were imposed on areas including Pinetown South and Washington Heights.

A new pool or a resurface ends with a full fill. If your area is on restrictions, ask the builder when they'd fill and whether a tanker delivery is an option.

Swimming Pools prices in KwaZulu-Natal

Published guides suggest Durban prices sit close to Gauteng's. SwimmingPoolBuilders.co.za's 2026 table puts concrete pools in Durban from about R240,000 and fibreglass from about R150,000, and adds 5 to 10% on coastal sites for marine-grade hardware. Completo notes that Durban's humidity and salt air mean more frequent chemical balancing and faster equipment corrosion, so budget for higher upkeep.

Swimming Pools in KwaZulu-Natal: questions

How close to a servitude can I build a pool in Durban?

Under Durban's Building By-laws, an in-ground pool relying on the surrounding soil for support must be at least one and a half times its depth from any servitude boundary, measured point by point. The City Engineer may allow less if other stability measures satisfy them.

Can I fill my pool with borehole water in eThekwini?

Only with the municipality's prior consent. eThekwini's Water By-law, 2023 requires you to show the water meets SANS 241-1 drinking-water standards and poses no health risk. The consent can carry conditions, and the municipality can withdraw it if the water stops complying.

Is it a bad time to fill a pool in Durban?

It depends on your supply zone. A pump failure supplying Durban Heights Treatment Works cut supply in early October 2026, and parts of Pinetown South and surrounding areas were placed on restrictions later that month. Check the municipality's current notices for your suburb before booking the fill.

Do pools near the sea cost more to run?

Usually. Price guides add 5 to 10% to build on coastal sites for marine-grade hardware, and note that humidity and salt air on the KZN coast mean more chemical balancing and faster corrosion of pumps and fittings. Ask for corrosion-resistant equipment in the quote.
